Discovery of child hood and spirit of neglect.
1. Abuse: Commission of an act upon a child.
2. Neglect: Omission ***********
The state now finds child abuse in that statutory way. Critics claim that the new statutes allow way too much government intervention, “My house my castle”,
Some jurisdictions 19 out of 50 states still premit spanking as resonable discipline.
Stross: I believe it leads to child maltriment »>spanking
Child prevention act:
Reporters: mandatory reporting by law any person who witnesses or learns of child maltreatment
teachers
medical field
anyone in work field with children.
(doctors were scared of this) = their concern was financial punishment
*Do we report to law enforcement or social services??
The incident of child maltreatment continues to go down 2.8 allegded cases on children in 2000.
15% decline in 6 or 7 years = less violence or less reporting??
Characteristics of maltreated children:::::
*Survey data shows race matters
******Clinical research says race does not matter (once you are in the emergency room race disappears)
*Social economic status official data shows social class has a tendency to be more violent because middle class and upper class have more resources.
(relationship between lower class= and maltreatment)
++++Upper class can go places to seek help and resources so they go un reported!!
>Neglect can be just as damaging as abuse (withholding love)
——-watch “gatekeepers” teachers
Abuse depends on certain queues that are either absent or present.
********Upper class abuse gets hidden
Theories of maltreatment
1.Intra individual (inside)
2.Social cultural
3. Social learning
——Sex Offenders LAws: ——
*Megans Law: (in book)
(most deaths occur 0 to 4)
Three risk categories
1.(lowest) By in large the state must notify the victim and local law enforcement when the perp was moving back into town
2.(medium) Diagnosed as sexual offender must enform the local schools as well as local young kid organizations when they move into the neighborhood
3. (most dangerous) Sexual violent predator whole community is notified of presence
**********Kansas vs. Hendrick (1997)*****************
—-Claims double jeperady
—-Court ruled against saying it is okay to keep applying sentence because he can still be a threat after he has served his time.
This law dealt with sex offenders as well as rapists even statutory consensual rape.
Rapists, homicides , and one more he can’t rape.
—Rapists have one of the lowest repeat of behavior across the board 9% .
(majority of rape is date rape)
—-Homicide repeat behavior is at 27% High on the scale.
(status matters = do not know why this is important he is an idiot)
>Children and death penalty…
>Children and life in prison.
Us supreme court deemed kids more vulnerable to negative forces in life to lean them towards criminal behavior such as peer pressure.
Unlike adults they cannot control or escape dysfunctional homes or neighborhoods.
Environment can produce a certain kind of kid.
-One approach would be alter their environment.
-Support families in trouble.
-More resources a family has the less stress their will be.
-Greater chance for rehabilitation for younger offenders.
>It is misguided to compare the offenses of a minor and the offenses of an adult because they are separate.
>Juveniles that are transferred into the adult justice system are more likely to create more delinquency.
-2010 movement is going towards life in prison without the possibility of parole.
- Applies same logic in Gramm vs Florida concluding that children convicted of non homicides crimes could not be sentenced to life in parole.
-juveniles are more likely to be able to change and be rehabilitated.
-Activist supreme court would be one that overturns established supreme law.
-Laws and previsions allow children to die behind bars. HERTZ
-State legislators have made life without parole widely more available for adult offenders.
***Hysteria “super predators” juvenile violent offenders…it was nothing but a ghost story a terrifying myth. William Bennet author of morals for kids.
-John Dijulio
-John Waters - notes juvi crime rates went down, growing rate of children of color found themselves in prison for life without any chance of changing or reforming.
-Research, understand, explain , and predict.
-Involving standards of decency.
-debunking of viscous myths.
- John Dilulo <—- BUSH’s crime force …”1996 a new group of criminals is among us the youngest, the biggest, the baddest any society has ever known.”
(the data however showed juvi crimes going down sense 1994) - data be damned.
this is not true the data does not support his claim…=hysteria
-juvenile crime has been described as crazy hysteria …cries of wolf constantly.
(cannot be taken seriously without fundamental evidentiary proof.)
It says fuck off! And no you may not see it
Two hours to kill sitting alone realizing really how fucking unimportant I am…
I will never be a priority in any ones life until I start making my self number one in my own.
Bang Bang
My baby shot me down.

>Intimate Partner Violence: includes families, both men and women victims, ex’s, and siblings.
-Term holds more power then Domestic Violence.
(Violence within our primary relationships)
Defined: Husbands and other close personal relationship cohabitants that are treated with dangerous amounts of violence.
(Researchers say that those who do not live together before marriage have a larger chance of violence to occur in the home after the wedding and the move was made.)
»> Scientific Journals did not mention family or intimate violence until 1970!!!!!!!!!!!
-A new group of victims were discovered. (the family)
-Medical model = people are sick (can be treated)
-Criminal Justice Model = People are bad…then what do we do?
(This very ideology is why the family violence has not received the criminal attention it needs.)
-The topic has always and will always be power and control.
(Woman now a days don’t realize how far we have come in the feminist movement)
-Supreme court condoned wife beating until the early 1900’s
***And yet to pass the equal rights amendment for man and woman in America!! ( what the hell> ??)
~ Family privacy against policy intervention. Which is greater!?!
»>“Wife beating is not a destructive sense of the words a deviant or pathological act rather it is a form of behavior that has existed for centuries to dominate woman which are still accepted in all of our judicial and public systems in the united states of this america.” Dolbish & Dolbish ( Men send flowers women receive them )
- The extent of Spousal Violence:
* 1980 Strous etal > found 16 out of 100 reported one violent episode in the last year.
* Gelles & Straus: 1 out of every 4 couples will be abused in their lifetime.
( Majorly under-reported)
* 1995 - 26% female murder victims were killed by their husbands or boy friends.
»>Leaving the violent relationship puts the victim at the greatest amount of risk.
* Half of murder victims were related or involved with their assailant.
-Crimes of passion
-Heat of the moment
*Other half 26% were killed by strangers and the other 24% were unknown.
(number killed by strangers are slower going up and killed by friends and family is slowly going down)
“Serial Partner Predators” : career criminals after sixth offense.
- no way to predict who the violent folks will be.
-Abusers from colony in Massachusetts 15% were found to be serial predators by searching offenders that had several restraining orders by several different victims. (study done in 1990)
-How do we protect the next offender
-Few states have shown increases in punishment after multiple burglary crimes but not several domestic disturbances. <—-dumb
-These acts are defined and prosecuted as misdemeanors not felonies.
-Texas: third offense non violent felony = life in prison. Any amount of prosecutions for violent family crime…no increase in punishment.
-Almost half individual offenders that were convicted of abuse are not with their original victims but a majority if not all are still offending…
